This Privacy Policy describes the types of information we collect when you use Truthly.com ("Website") and our associated services, how that information is used and protected, and the choices available to you regarding your data. By visiting our Website or using our services, you consent to the practices described here.

This Policy applies to two distinct categories of personal information: (1) information you provide directly when creating an account, making a purchase, or conducting a search on our Website; and (2) information aggregated from licensed third-party data sources and publicly available online content, which forms the basis of our people search results.

Residents of California, Nevada, and Oregon have additional rights under their respective state privacy statutes. Residents of Colorado, Virginia, Connecticut, Montana, Utah, Texas, and other states with active privacy legislation also hold certain rights. State-specific disclosures are provided in the supplemental section below.

Truthly extends baseline data control rights to all U.S. residents regardless of state. You do not need to be in a state with a specific privacy law in order to submit a request to access, correct, delete, or opt out of the sale of your personal information.

Overview of Our Data Practices

Truthly operates as an information portal that enables individuals to search licensed public-record data for lawful personal purposes, such as verifying an online identity or locating a lost contact. Search results are generated from licensed data and publicly available internet sources — not from information you personally provide on this Website.

We do not sell, exchange, or disclose Personal Information submitted through account creation or purchase flows except as specifically described in this Policy. "Sale" as used here conforms to applicable privacy law definitions and refers to sharing data with third parties for monetary or equivalent commercial consideration. Truthly does not engage in cross-context behavioural advertising or automated profiling of individual consumers.

We maintain a strict separation between (a) data you provide directly on this Website and (b) data retrieved from our licensed search index. These datasets are not combined or cross-enriched.

1. Information Collected Directly from You

1a. Account and Identity Information

What We Collect: First and last name, email address, phone number, billing address, credit or debit card details, and IP address. Where you use our image search feature, you may also upload a photograph.

How We Use It: This information is used for account creation and management, processing and billing membership purchases, delivering customer support, conducting internal analytics, and detecting and preventing fraud. Uploaded images are used solely to perform your requested reverse image search and are never sold or shared with advertising vendors. We have disclosed (but not sold) this category of information since January 1, 2022.

1b. Transaction and Purchase History

What We Collect: Records of membership purchases, upgrade history, and patterns of service usage.

How We Use It: Used to fulfil your membership, process recurring billing, deliver relevant service communications, and improve our offerings. Disclosed to our billing processor, customer service platform, and analytics providers since January 1, 2022.

1c. Usage and Interaction Data

What We Collect: Page views, search queries entered on our Website, clickstream behaviour, session timestamps, and analytics data gathered via Google Analytics.

How We Use It: Used to maintain your search history, improve service quality and relevance, respond to support requests, and identify unusual or fraudulent activity. Disclosed (but not sold) to analytics and customer service vendors since January 1, 2022.

1d. Device and Technical Information

What We Collect: Browser type, operating system, screen resolution, and device category used to access the Website.

How We Use It: Used to optimise Website rendering across device types, support fraud prevention, and improve the overall user experience. Disclosed (but not sold) to analytics providers since January 1, 2022.

2. Information Sourced from Licensed and Public Data

2a. Identity and Contact Information

What We Collect: Full names, known aliases and usernames, current and historical email addresses, physical addresses, phone numbers, profile images from public sources, and publicly accessible social media profiles.

How We Use It: Disclosed and made available to subscribers since January 1, 2022, for the purpose of providing identity verification and people search services.

2b. Demographic Information

What We Collect: Age, approximate birth year, gender, marital status, and languages potentially spoken — where publicly available.

How We Use It: Included in search results delivered to subscribers for identity verification purposes. Disclosed since January 1, 2022.

2c. Professional and Employment Information

What We Collect: Job titles, employer names, industry categories, and approximate employment periods where publicly available.

How We Use It: Included in subscriber reports for identity verification purposes. Disclosed since January 1, 2022.

Note: Under most state privacy statutes, "personal information" excludes information that is publicly available from government records, deidentified data, or aggregated consumer information that cannot be linked to a specific individual.

Deidentification commitment: Where Truthly deidentifies data, we implement technical and organisational measures designed to prevent re-identification and require that any subcontractors receiving deidentified data maintain equivalent standards by contract.

3. How We Obtain Information

  • Directly from you when you register an account, purchase a membership, or conduct a search.
  • Automatically through your browser and device when you access the Website (e.g., IP address, cookies, usage logs).
  • From licensed third-party data aggregators and commercial data providers.
  • From publicly available websites and online databases.

4. How We Use Personal Information

We use the information we collect for the following purposes:

  • Delivering the people search services you request, including identity verification and locating lost contacts.
  • Operating, maintaining, and continuously improving our Website and service features.
  • Creating and managing your account and personalising your experience.
  • Processing payments and subscriptions, and preventing transactional fraud.
  • Maintaining the security and integrity of our systems, databases, and infrastructure.
  • Complying with legal obligations, responding to lawful requests from government or law enforcement authorities, and enforcing our Terms.
  • Evaluating or completing corporate transactions such as mergers, acquisitions, or asset sales where user data may be transferred as a business asset.

5. Sensitive Personal Information

Truthly does not collect or process sensitive personal information beyond what is strictly necessary to deliver our services and prevent fraud. Sensitive personal information includes — but is not limited to — data revealing racial or ethnic origin, religious beliefs, health conditions, sexual orientation, immigration status, biometric identifiers, or precise real-time geolocation. Payment card data is used solely to process your transaction and is handled through PCI-compliant third-party processors.

6. Cookies and Passive Data Collection

When you visit our Website, our servers automatically log technical information including your IP address, browser type, device identifiers, referring URL, and the pages you visit. This data helps us diagnose technical issues, monitor service health, and understand how our Website is used.

We use cookies — small data files stored in your browser — to maintain session state and improve the experience of returning visitors. Truthly's own cookies do not collect personally identifiable information, and we do not link cookie data with your account information or search activity for advertising purposes.

7. International Users

Truthly's Website and services are hosted and operated in the United States and are intended for U.S. residents. If you are accessing our Website from outside the United States, your data may be transferred to and processed in the United States, which may have different data protection standards than your country of residence. By using our Website, you consent to such transfer and processing.

8. Data Retention and Security

For information you provide directly (account registration, billing), we retain that data for three years following your last login, or until you delete your account, whichever is earlier. Exceptions apply where data is required for legal compliance, fraud investigation, customer service, or audit purposes.

For search result data sourced from licensed or public sources: if you search without an account, no results are retained after your session ends. If you are logged in, your account retains a copy of your search results until you delete them, your account is closed, three years pass without a login, or we receive a valid deletion request.

We maintain administrative, technical, and physical safeguards appropriate to the sensitivity of the data we hold. No security system is entirely impenetrable, and we cannot guarantee absolute protection against all potential threats. We will notify affected users of any confirmed data breach as required by applicable law.

9. Fraudulent or Abusive Consumer Requests

Where Truthly has a well-documented, good-faith basis to believe a consumer request is fraudulent or submitted in bad faith, we reserve the right to deny that request and will provide you with written notice of the reason. Examples of circumstances that may lead to denial include:

  • Submitting a request that purports to be from another individual without documented authorisation from that individual.
  • Attempting to obscure your identity through technical means such as VPN usage, header manipulation, or anonymised email services.
  • Sending bulk, automated, or unverified requests without adequate identity documentation.

10. Removal Requests from Law Enforcement and Public Officials

Active or retired law enforcement officers, judicial officers, and certain other public servants whose personal information is protected under applicable state law may request removal of their information from our search results. To do so, email privacyrequests@truthly.com with the specific URLs containing your information and documentation confirming your qualifying status. Identity verification will be required.

Please note: removal from Truthly's search index does not constitute removal from public records or other third-party websites that may independently host the same information.

11. Global Privacy Control and Opt-Out Signals

Truthly honours opt-out preference signals transmitted through the Global Privacy Control (GPC) standard where technically feasible. Because our search results are retrieved from external licensed databases — not from data tied to your browser session — we cannot automatically link a GPC signal from your browser to records held in those databases. If you wish to opt out of the sale of your personal information, please submit a direct request to privacyrequests@truthly.com.

12. Children's Privacy

Our Website is intended exclusively for users aged 18 and older. We do not knowingly collect personal information from individuals under the age of 18. If you are a parent or guardian and have reason to believe your child has submitted personal information to us, please contact us at support@truthly.com and we will take prompt action to locate and delete that information.

13. No Third-Party Beneficiaries

This Privacy Policy is entered into solely between Truthly and you. Nothing in this Policy creates or confers any enforceable rights on any third party.

14. Changes to This Policy

We may revise this Privacy Policy periodically to reflect changes in our data practices, legal requirements, or service offerings. When we make material changes, we will post the updated Policy on this page with a new effective date and, where appropriate, notify you by email. We encourage you to review this Policy periodically. Continued use of the Website after an update constitutes acceptance of the revised Policy.

If additional time is required, we will notify you and may extend up to 90 days total. You may make this request up to twice within any 12-month period.

How to Submit a Request to Delete

Submit via our Request for Deletion Form or by emailing privacyrequests@truthly.com. We will acknowledge your request and respond within 45 days (up to 90 days with notice). Where we are required by law to retain certain information, we will inform you of the applicable exception.

How to Submit a Request to Correct

Submit via our Request to Correct Form or by emailing privacyrequests@truthly.com. We will endeavour to respond within 45 days (up to 90 days with notice). We will take into account the nature of the information and our intended use when determining whether correction is feasible.

How to Opt Out of the Sale of Your Information

Submit via our Do Not Sell or Share My Personal Information form or by emailing privacyrequests@truthly.com. We will process your request within 15 business days. If we have a documented good-faith basis to believe your request is fraudulent, we will deny it and provide a written explanation.

Additional Details for California Requests

  • Authorised Agents — if you are submitting on behalf of a consumer, you must provide a copy of signed written authorisation from that consumer and be prepared to have your authority verified.
  • Identity Verification — we will take steps to verify your identity before processing any request. We cannot fulfil a request if we are unable to confirm who you are.
  • Search Scope — our records search will be conducted using the name you provide. Alternative spellings, initials, or suffixes must be submitted separately.
  • Non-Discrimination — exercising your CCPA/CPRA rights will not result in you being denied services, charged higher prices, or receiving a lower level of service.

Do Not Track

Truthly does not currently respond to browser-level Do Not Track (DNT) signals. No uniform industry standard for interpreting DNT signals has been established. If a standard is adopted, we will revisit this position. In the meantime, you may submit a direct opt-out request to privacyrequests@truthly.com.

California Shine the Light

California residents may request, once per calendar year and at no charge, information about whether Truthly has disclosed personal information to third parties for their direct marketing purposes during the preceding calendar year. Truthly does not sell or share user information with third parties for direct marketing without user consent.

California Minor Erasure Rights

California residents under the age of 18 who are registered users may request removal of publicly visible content they have posted through our services. Requests should be submitted to privacyrequests@truthly.com with a description of the content and the URL(s) where it appears. We will make reasonable efforts to remove the content from public view, though we cannot guarantee removal from all caches, backups, or third-party archives.

Nevada Disclosures (NRS Chapter 603A)

Your Right to Opt Out of Sales

Nevada law grants consumers the right to opt out of the sale of certain personally identifiable information collected through websites and online services. This includes information such as your name, home address, email address, telephone number, and any other identifier that allows a business to contact you.

How to Submit an Opt-Out Request

Email your request to privacyrequests@truthly.com or submit through our Request for Deletion Form. We will acknowledge your request and endeavour to process it within 60 days. Where additional processing time is required, we will notify you and may extend by up to 30 additional days.

Authorised Agents

Requests submitted on behalf of another consumer must be accompanied by written authorisation signed by that consumer. We will verify the agent's authority before processing the request.

Verification and Denial

We will take reasonable steps to verify your identity before processing your request. If we are unable to verify your identity or authority, we will deny the request and inform you of the reason. We reserve the right to deny requests on any ground permitted by applicable law.

Search Scope Notice

Our records search will be conducted using the name as submitted. Name variations, initials, alternative spellings, or suffixes must be specified explicitly in your request to be included in the search.

Oregon Disclosures (OCPA)

Your Rights Under the Oregon Consumer Privacy Act

Oregon residents have the following rights under the Oregon Consumer Privacy Act (OCPA):

  • Right to Know — request a copy of the personal information Truthly has collected about you and information about how it is used and shared.
  • Right to Delete — request that Truthly delete personal information it holds about you.
  • Right to Correct — request correction of inaccurate personal information.
  • Right to Opt-Out — request that Truthly stop selling your personal information, using it for targeted advertising, or profiling you for decisions with significant legal or similar effects.
  • Right to Revoke Consent — withdraw any prior consent you provided to the processing of your personal information.

Submitting Requests

All requests may be submitted by emailing privacyrequests@truthly.com or through the relevant form on our Website. We will acknowledge receipt and endeavour to respond within 45 days. If we require additional time, we will notify you and may extend our response period by up to 45 additional days.

Opt-Out and Consent Revocation

Submit opt-out or consent revocation requests to privacyrequests@truthly.com or through our Do Not Sell My Personal Information form. We will process valid requests within 15 business days. Requests we believe to be fraudulent will be denied with a written explanation.

Additional Details for Oregon Requests

  • Authorised Agents — written signed authorisation from the consumer is required for requests submitted by a third party on their behalf.
  • Verification — we will verify your identity before processing. If verification fails, your request will be denied.
  • Search Scope — searches are conducted using the name as provided. Alternative forms of the name must be specified separately.
  • Non-Discrimination — we will not penalise you for exercising your rights under the OCPA.

Right to Appeal

If Truthly denies your consumer request, you have the right to appeal that decision within a reasonable period following receipt of our denial notice. To initiate an appeal, reply to our denial email with the grounds on which you believe the denial was in error. We will review and respond to all appeals within 45 days of receipt.

General U.S. Resident Privacy Disclosures

Applicable States

In addition to California, Nevada, and Oregon, the following states currently have consumer privacy statutes in effect: Colorado, Virginia, Connecticut, Montana, Utah, and Texas. Additional states with privacy laws coming into effect soon include Iowa, Minnesota, Delaware, Tennessee, Indiana, New Hampshire, New Jersey, Nebraska, Kentucky, Maryland, and Rhode Island.

Truthly voluntarily extends privacy request rights to all U.S. residents. Even if your state does not have a specific privacy law, we will process your request, though we cannot guarantee response within any statutory timeframe.

Truthly derives a substantial portion of its revenue from providing personal information services used in fraud detection and identity verification. Accordingly, Truthly registers as a data broker under the Texas Data Broker Law and similar statutes in states that impose such requirements.
