If you do not agree, you must discontinue use of the Website immediately.

THESE TERMS INCLUDE A MANDATORY ARBITRATION PROVISION AND A WAIVER OF CLASS ACTION RIGHTS. BY CONTINUING TO USE THIS WEBSITE, YOU AGREE THAT DISPUTES WILL BE RESOLVED THROUGH INDIVIDUAL BINDING ARBITRATION RATHER THAN IN COURT OR BEFORE A JURY.

Binding Arbitration and Class Action Waiver

SUBJECT TO ANY EXCEPTIONS REQUIRED BY APPLICABLE LAW, ALL DISPUTES, CLAIMS, OR CONTROVERSIES BETWEEN YOU AND THE COMPANY — INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, SUBSIDIARIES, AND AFFILIATES — ARISING FROM OR RELATING TO THESE TERMS, THE WEBSITE, ANY MEMBERSHIP PLAN, OR THE BACKGROUND INFORMATION SERVICES SHALL BE SUBMITTED TO FINAL AND BINDING ARBITRATION. YOU WAIVE ANY RIGHT TO HAVE SUCH MATTERS DECIDED BY A JUDGE OR JURY.

Arbitration proceedings will be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules, available at www.adr.org or by contacting AAA at 1-800-778-7879. Truthly supports flexible arbitration formats — including telephone, video conference, and document-based proceedings — to minimise inconvenience to consumers.

YOU ACKNOWLEDGE THAT BY AGREEING TO THESE TERMS YOU ARE WAIVING YOUR ABILITY TO PARTICIPATE IN CLASS-ACTION LITIGATION. ALL CLAIMS MUST BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY. ANY ARBITRATION AWARD MAY NOT BE CONSOLIDATED WITH ANY OTHER ARBITRATION OR CLAIM INVOLVING ANOTHER PARTY.

Eligibility and User Representations

Use of this Website is restricted to individuals who are at least 18 years of age, or the applicable age of legal majority in their jurisdiction of residence, whichever is greater. By accessing the Website you represent and warrant that you satisfy this requirement.

You further represent that all information you submit to the Website is truthful, current, and accurate. The Company reserves the right to suspend or permanently terminate your access and void any pending transactions if it determines, in its reasonable judgment, that information you have provided is false or misleading.

By initiating a search on this Website you acknowledge that: (i) your use of the service is subject to the laws of the State of California; (ii) access to full records requires a paid Membership Plan; and (iii) you waive any state or federal claim related to privacy or publicity rights with respect to names submitted as search queries.

License to Use

Website Access License

Conditioned on your ongoing compliance with these Terms, the Company grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Website for your own lawful, non-commercial purposes. No intellectual property rights or ownership interests in the Website or its content are transferred to you.

Background Information Services License

Upon activating a Membership Plan, the Company grants you a limited, non-exclusive license to access the Background Information Services exclusively for personal, non-commercial purposes. You are prohibited from using the Background Information Services for commercial purposes, collection activities, government functions, marketing or advertising campaigns, or resale. You may not use the service to develop, train, or benchmark a competing product.

You acknowledge that reports generated through the Background Information Services may contain personally identifiable information. You accept sole responsibility for maintaining the security and confidentiality of all such information you access.

Prohibited Conduct

You agree not to engage in any of the following when accessing or using the Website:

  • Deploy automated tools including bots, crawlers, scrapers, or scripts to access, extract, or monitor any part of the Website.
  • Attempt to circumvent or breach the security controls, authentication systems, or access restrictions of the Website.
  • Conduct vulnerability testing, port scanning, or penetration testing against the Website or its underlying infrastructure.
  • Manipulate HTTP headers, impersonate another user or entity, or falsify your identity in any way.
  • Harvest, collect, or compile contact information of other users or third parties from the Website.
  • Use the Website for any purpose that violates applicable law, infringes third-party rights, or damages the Company's reputation.
  • Copy, redistribute, resell, or commercially exploit any data, reports, or content obtained through the Website.

REPRODUCTION, REDISTRIBUTION, OR COMMERCIAL EXPLOITATION OF ANY SEARCH RESULTS OR REPORTS GENERATED BY TRUTHLY — INCLUDING PRINTING, DIGITAL COPYING, OR RETRANSMISSION — IS STRICTLY PROHIBITED. VIOLATION OF THIS PROVISION MAY CAUSE IRREPARABLE HARM TO THE COMPANY AND ENTITLE THE COMPANY TO SEEK INJUNCTIVE RELIEF IN ADDITION TO OTHER AVAILABLE REMEDIES.

Fair Credit Reporting Act — Important Notice

TRUTHLY IS NOT A CONSUMER REPORTING AGENCY AS DEFINED UNDER THE FAIR CREDIT REPORTING ACT ("FCRA"), 15 U.S.C. §§ 1681 ET SEQ., AND THE INFORMATION WE PROVIDE DOES NOT CONSTITUTE A CONSUMER REPORT.

You may not use any report, data, or information obtained from Truthly as a factor in evaluating a person for:

  • Credit, loans, or any other financial product
  • Employment screening or hiring decisions
  • Insurance underwriting or eligibility
  • Educational admissions, scholarships, or fellowships
  • Rental housing or residential accommodation decisions
  • Any other purpose governed by the FCRA

By activating a Membership Plan and accessing the Background Information Services, you expressly confirm that you will not use any information retrieved through Truthly for FCRA-regulated purposes.

California Privacy Rights Act — Search Data Obligations

A. You acknowledge that certain information accessible through Truthly services qualifies as Personal Information under the California Privacy Rights Act (Cal. Civ. Code § 1798.140).

B. Permitted Purpose. Personal information pertaining to California consumers that you access through Truthly is provided exclusively to support identity verification, the location of lost contacts, and fraud prevention. It may not be used to generate consumer credit reports or for commercial resale.

C. You agree not to retain, disclose, combine, update, or use for targeted advertising any California consumer Personal Information accessed through Truthly, except as permitted under this section.

D. You will maintain commercially reasonable security safeguards over any California consumer Personal Information you receive from Truthly.

E. You agree to cooperate with Truthly in fulfilling its obligations under the California Consumer Privacy Act and California Privacy Rights Act, including responding to consumer rights requests that affect data you have accessed.

F. You agree to comply independently with all other applicable provisions of California privacy law to the extent they apply to your use of data obtained from Truthly.

G. If compliance with any provision of this section is not possible, you must notify Truthly within five (5) calendar days by emailing support@truthly.com and immediately cease all use of Truthly services.

Order Acceptance

All purchases made through the Website are subject to acceptance by the Company. We reserve the right to decline or cancel any order at our discretion and for any reason, including but not limited to suspected fraud, payment issues, or prior account violations. If a cancellation occurs after your payment method has been charged, we will refund the full amount.

If you do not receive an order confirmation, please contact our support team at (844) 422‑8347 before submitting another order. Duplicate charges arising from multiple submissions will be refunded upon request.

We may, without notice, restrict order quantities per person, household, or billing address where we have reason to believe that orders are associated with fraudulent activity, invalid billing information, or prior chargeback history.

Membership Plans

Truthly offers the following recurring membership options:

  • Monthly Membership — renewed and billed every 30 days.
  • Quarterly Membership — renewed and billed every 90 days at a reduced per-month rate.

Your Membership Plan governs the scope of search features and report access available to you. Memberships renew automatically until cancelled.

Plan Upgrades

You may upgrade your plan at any time. An incremental charge will apply and upgraded benefits will activate immediately upon payment confirmation. The price differential will be clearly presented before you confirm the upgrade.

Cancellation

Memberships can be cancelled at any time using any of the following methods:

  • Phone: Call us toll-free at (844) 422‑8347. Our team is available Monday – Friday, 6:00 AM – 6:00 PM Pacific Time.
  • Email: Write to us at support@truthly.com requesting cancellation. Include the email address associated with your account.
  • Dashboard: Log into your account, navigate to Account Plan Details, and select the cancellation option. A confirmation email will be sent.

Cancellations are always free of charge. Your access will remain active until the end of the current billing period.

Refund Policy

Because generating a search report incurs immediate data retrieval costs, Truthly does not issue refunds once a search has been initiated or report data has been accessed. This applies regardless of whether you viewed the full results.

If you are dissatisfied with your results or believe a report is incomplete, our support team is available to review your case and, where appropriate, assist you with a follow-up search at no additional charge.

Taxes

Membership fees may be subject to applicable sales or use taxes depending on the state in which you reside. Any applicable taxes will be displayed at checkout prior to purchase confirmation.

Promotions and Pricing

Promotional rates and discount offers are time-limited and may not be combined with other offers unless explicitly stated. The applicable price for any Membership Plan will be displayed clearly on the checkout page before your purchase is confirmed. Promotional pricing applies only to the initial billing cycle unless otherwise stated.

Billing Disputes

If you believe a charge to your account is incorrect, contact our customer service team promptly by phone at (844) 422‑8347 or by email at support@truthly.com. We will investigate and, where a billing error is confirmed, issue a correction or refund within a reasonable timeframe.

Payment Terms

All charges are billed in United States dollars. We accept payment via major credit and debit cards. By placing an order you authorise the Company to charge your selected payment method for the applicable fees and any recurring charges associated with your Membership Plan.

Charges may appear on your statement under the descriptor "TRUTHLY" or the name of our payment processor. If you have questions about a charge appearing on your statement, call us at (844) 422‑8347.

We reserve the right to revise pricing with advance email notice. Continued use of your Membership Plan following a pricing notice constitutes acceptance of the revised fees.

Data Opt-Out Requests

If you wish to have your personal information removed from our search index, you may submit an opt-out request through the opt-out form available on our Website. You will be required to verify your identity via email and identify the specific URLs containing your information. Removal applies to those specific pages only; it does not affect your information held in public records or on third-party websites.

User-Generated Content

Certain features of the Website may permit users to submit content, feedback, or other materials. When using those features you agree not to submit content that:

  • Disrupts, overloads, or impairs the normal operation of the Website.
  • Defames, harasses, threatens, or invades the privacy of any individual.
  • Infringes copyrights, trademarks, trade secrets, or any other proprietary rights.
  • Encourages or facilitates unlawful conduct or gives rise to civil liability.

  • Impersonates any individual, company, or Truthly employee.

License to User-Submitted Content

By submitting any content to the Website, you grant Truthly a worldwide, royalty-free, irrevocable, non-exclusive, sublicensable license — valid for ten (10) years and renewable at the Company's election — to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and promoting the Website and its services.

We are not obligated to retain or store any submitted content and recommend that you do not upload sensitive or confidential material.

Intellectual Property

All content on the Website — including but not limited to text, graphics, user interfaces, photographs, audio and video clips, software code, and data compilations — is owned by or licensed to the Company and protected under United States and international intellectual property law.

The Company reserves the right to monitor and log all activity on the Website for security and compliance purposes without prior notice.

Feedback and Suggestions

We welcome your ideas for improving our service. By sending feedback or suggestions to Truthly, you grant the Company a perpetual, royalty-free, irrevocable license to use, implement, adapt, and share that feedback in any manner and for any purpose, without compensation or attribution to you. You represent that any feedback you submit does not infringe third-party intellectual property rights.

Third-Party Services and Links

The Website may contain links to or integrations with third-party websites, services, or advertisements. Truthly does not endorse, control, or accept responsibility for the content, accuracy, or practices of any third party. Your interactions with third-party services are governed solely by their own terms and policies.

Disclaimers and Limitations of Warranty

Truthly will make commercially reasonable efforts to deliver accurate and current information through its Background Information Services. However, because our data is sourced from third-party providers, we cannot guarantee its completeness, accuracy, or currency. ALL SERVICES AND CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

To the maximum extent permitted by applicable law, the Company, its affiliates, data suppliers, and service providers (collectively, "Released Parties") shall not be liable for any loss, injury, or damages of any kind arising from your use of or inability to use the Website, the Background Information Services, or any content obtained through the Website.

WHERE APPLICABLE LAW PROHIBITS THE EXCLUSION OR LIMITATION OF LIABILITY, THE AGGREGATE LIABILITY OF THE RELEASED PARTIES TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, contractors, agents, shareholders, and affiliates from and against any claims, liabilities, losses, damages, and expenses — including reasonable attorneys' fees — arising from: (a) your use of the Website or Background Information Services; (b) your breach of these Terms; or (c) your use of information obtained through the Background Information Services in a manner inconsistent with these Terms or applicable law.

Compliance Audit

The Company and its data providers reserve the right to audit your use of the Background Information Services on reasonable notice. You agree to cooperate fully with any such audit and to provide a written response to audit inquiries within ten (10) business days. Audit rights may be exercised periodically to verify compliance with these Terms.

Digital Millennium Copyright Act (DMCA)

Truthly respects intellectual property rights and will respond to valid notices of copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512. Required Elements of an Infringement Notice

Truthly will terminate the accounts of users who are determined, in our reasonable judgment, to be repeat infringers of third-party intellectual property rights.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any claim not subject to arbitration under these Terms must be brought within one (1) year of the date on which the claim arose, and must be filed exclusively in the state or federal courts located in Riverside County, California.

The Website is operated from the United States. Accessing the Website from a jurisdiction where any component of our service is unlawful is prohibited.

Term and Termination

These Terms become effective the moment you first access the Website, register an account, submit a search query, initiate a purchase, or enter payment information — whichever occurs first.

The Company may suspend or permanently terminate your access to the Website at any time, with or without cause, and without prior notice. Upon termination, your right to use the Website and any associated services ceases immediately.

Waiver and Severability

A failure by either party to enforce any provision of these Terms shall not constitute a waiver of that party's right to enforce the same or any other provision in the future. If any provision of these Terms is held invalid or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Electronic Agreements

These Terms, together with the Company's Privacy Policy and any applicable order confirmations or plan-specific terms, constitute the entire agreement between you and the Company regarding your use of the Website and supersede all prior agreements or understandings, whether written or oral.

We may update these Terms at any time by posting a revised version to the Website and notifying you by email where required. Continued use of the Website following notice of changes constitutes your acceptance of the updated Terms.
